New Hampshire: Everything You Need to Know

New Hampshire Laws

New Hampshire’s therapeutic cannabis program was established by House Bill 573 in 2013 and became operational in 2016. The program is regulated by the New Hampshire Department of Health and Human Services. Patients with qualifying medical conditions can receive certification from licensed healthcare providers and purchase medical cannabis from state-licensed Alternative Treatment Centers.

  • Patients must be New Hampshire residents.
  • Physicians, advanced practice nurses, and physician assistants can certify patients for medical cannabis.
  • Cannabis is available only through seven licensed Alternative Treatment Center dispensaries statewide.
  • Home growing is strictly illegal with no exceptions for patients or caregivers.
  • Patients may designate up to two caregivers to pick up medicine for them.
  • Medical cannabis cannot be used in public places or on others’ property without written permission.
  • Driving under the influence of cannabis is illegal.
  • Recreational marijuana is illegal.

New Hampshire Reform Timeline

  • 2016 – Dispensaries Open: Licensed Alternative Treatment Centers begin serving registered patients, making New Hampshire the 19th state with operational medical marijuana sales.
  • 2017 – Conditions Added: Legislature adds chronic pain and PTSD to qualifying conditions, significantly expanding patient access.
  • 2024 – Major Expansion: Any debilitating or terminal condition now qualifies when providers believe benefits outweigh risks. Generalized anxiety disorder added as qualifying condition.
  • 2025 – Enhanced Reciprocity: Restrictions on visiting out-of-state patients removed, allowing them to purchase at same frequency as New Hampshire residents.

New Hampshire Possession Limits

New Hampshire sets clear limits on how much medical cannabis patients can possess and purchase.

  • New Hampshire medical cannabis card can be valid for up to three years, depending on the duration of the provider’s certification.
  • Patients may possess up to 2 ounces total at any time.
  • Patients may purchase up to 2 ounces every 10 days from any dispensary location.
  • Cannabis must stay in original packaging when outside your home.
  • Cannabis must be in locked container or trunk when transporting in vehicle.
  • Minors need certifications from two doctors (one must be a pediatrician) and a parent/guardian caregiver.
  • Out-of-state patients with NH-qualifying conditions can purchase the same amount of cannabis as In-state residents.
  • Home cultivation is illegal.
