Montana Laws

Montana’s medical cannabis program was established through voter-approved Initiative 148 in 2004 and is regulated by the Montana Department of Revenue. Qualified patients with physician recommendations can access medical cannabis through licensed dispensaries or home cultivation.

  • Patients must be Montana residents to obtain medical cannabis cards.
  • Recommendations must come from Montana-licensed physicians (MD or DO).
  • Qualifying conditions include cancer, HIV/AIDS, glaucoma, epilepsy, Crohn’s disease, PTSD, severe chronic pain, cachexia, intractable nausea or vomiting, painful peripheral neuropathy, muscle spasms from central nervous system disorders, and hospice care admission.
  • Home cultivation is allowed.
  • Minor patients require approval from two physicians unless the treating physician is an oncologist, neurologist, or epileptologist.
  • Caregivers may assist patients but are limited to serving no more than two patients at a time.
  • Recreational cannabis is legal.

Montana Reform Timeline

  • 2011 – Restrictions and Legal Challenges: Legislature passes restrictions on medical program limiting providers to three patients. Governor vetoes full repeal but some restrictions are blocked by courts.
  • 2020 – Recreational Cannabis Approved: Voters approve Initiative 190 legalizing recreational cannabis for adults 21 and over, effective January 1, 2021. Adult-use sales begin January 1, 2022.
  • 2023-2025 – Ongoing Refinements: Legislature passes multiple bills addressing licensing, testing requirements, THC limits, synthetic cannabinoids, and packaging standards. Home cultivation for adult use becomes legal July 1, 2023.

Montana Possession Limits

Montana law allows medical marijuana cardholders and recreational users to possess cannabis products within limits.

  • Medical cardholders may purchase up to 1 ounce of flower per day from licensed dispensaries.
  • Maximum monthly possession for medical patients is 5 ounces of flower (can petition for 8 ounces).
  • Conversion formula: 1 ounce of flower equals 800mg THC in edibles or 8 grams/8mL of THC concentrate.
  • Cardholders who name a provider may possess up to 1 ounce of usable marijuana.
  • Cardholders without a named provider may possess up to 4 mature plants, 4 seedlings, and the amount of usable marijuana allowed by state rules.
  • Two or more cardholders sharing a residence without providers may have a maximum of 8 mature plants, 8 seedlings, and state-allowed amounts.
  • Adult-use consumers (21+) may possess up to 1 ounce of marijuana for recreational purposes.
  • Registered medical cannabis patients can grow up to four mature plants and four seedlings at any one time.
  • Adults aged 21 and over may cultivate up to two mature recreational cannabis plants and two seedlings for personal use.
  • Patients must present valid Montana medical cannabis card and government-issued identification when purchasing from dispensaries.
  • Montana medical cannabis cards are valid for one year from the approval date.
