Massachusetts’s medical program was established under the Medical Use of Marijuana Act in 2012 and is regulated by the Cannabis Control Commission. Patients with qualifying conditions can get certification from approved healthcare practitioners and access medical marijuana through licensed Medical Marijuana Treatment Centers (MTCs).

• Patients must be Massachusetts residents aged 18+ with valid medical marijuana cards.
• Minors under 18 require approval from two licensed physicians with parental/guardian consent.
• Recreational use is legal for adults 21+.
• Home cultivation is permitted: up to 12 flowering and 12 vegetative plants per patient.
• Cultivation for recreational use: maximum 6 plants per adult, 12 plants per household.
• Out-of-state medical marijuana cards are not recognized. However, out-of-state visitors can legally purchase recreational marijuana if they are 21 or older.
• Massachusetts medical marijuana cards require annual renewal with updated physician certification.
• Driving under the influence remains illegal and subject to penalties.
• Public consumption is strictly prohibited in all forms.

• 2017 – Comprehensive Reform: “An Act to Ensure Safe Access to Marijuana” (Chapter 55) passed, creating the Cannabis Control Commission and updating medical marijuana regulations while also legalizing recreational use.
• 2018 – Dispensaries Begin Operations: Cannabis Control Commission issued final regulations in March and began licensing in April, with first adult-use dispensaries opening in November.
• 2022 – Equity Legislation: “An Act Relative to Equity in The Cannabis Industry” (Chapter 180) signed into law, creating social equity trust fund and simplifying expungement process.
• 2025 – Current Status: Fully operational medical program with licensed treatment centers statewide; Hardship Cultivation Registration program under development by Cannabis Control Commission.

Massachusetts law establishes possession limits based on medical need rather than specific THC quantities.

• Patients may possess up to a 60-day supply of marijuana, capped at 10 ounces, as determined by their certifying physician.
• Home cultivation permitted: up to 12 flowering cannabis plants and 12 vegetative plants per registered patient.
• All product forms available including flower, concentrates (up to 5 grams), edibles, vapes, and topicals.
• Patients must present valid Massachusetts medical marijuana card and photo identification when purchasing from treatment centers.
• Out-of-state patients cannot purchase from Massachusetts treatment centers regardless of their home state’s medical program.
