Colorado’s medical cannabis program was established in 2000 through Amendment 20 to the Colorado Constitution and is regulated by the Colorado Department of Public Health and Environment (CDPHE). Patients with qualifying conditions can receive medical marijuana cards and access medical cannabis through licensed dispensaries.

• Patients must be Colorado residents.
• Only physicians certified by the program may issue medical recommendations.
• Qualifying conditions include cancer, epilepsy, chronic pain, glaucoma, HIV/AIDS, and multiple sclerosis.
• Recreational marijuana is legal.

• 2022 – Purchase Limits Reform: Legislature updates daily concentrate purchase limits while requiring enhanced physician assessments including mental health review.
• 2025 – Ongoing Improvements: House Bill 25-1296 expands fee waiver documentation to include federal tax transcripts for low-income patients while continuing regulatory refinements for improved access.

Colorado law allows medical patients to possess larger quantities than adult-use consumers and permits home cultivation with physician oversight.

• Patients may obtain up to 2 ounces of flower per transaction as directed by their certifying physician.
• Daily concentrate limits are 8 grams for patients 21+ and 2 grams for patients 18-20.
• Home cultivation allows 6 plants, no more than 3 mature at any time.
• Residential properties are limited to 12 plants for recreational use.
• Caregivers may cultivate up to 24 plants, provided it is also allowed by local regulations.
• All cultivation must occur in enclosed, locked spaces not visible to the public.
• Colorado medical marijuana cards are valid for one year and require annual physician renewal.
