Washington: Everything You Need to Know

Washington Laws

Washington’s medical cannabis program was established in 1998 through Initiative 692 and is regulated by the Department of Health under the Cannabis Patient Protection Act. Patients require authorization from licensed healthcare providers and registration through medically-endorsed retail stores.

  • Patients must be Washington residents.
  • Medical patients must obtain authorization from licensed healthcare practitioners.
  • Medical cannabis is available exclusively through state-licensed, medically-endorsed retail stores.
  • Patients must visit a medically-endorsed dispensary and meet with a certified medical cannabis consultant to receive a recognition card.
  • Home cultivation is permitted for medical patients only.
  • No out-of-state medical card reciprocity is accepted.
  • Driving under the influence remains illegal and subject to penalties.

Washington Reform Timeline

  • 2012 – Recreational Legalization: Initiative 502 passes, legalizing recreational cannabis for adults 21 and older, making Washington the second state to do so.
  • 2014 – Retail Sales Begin: State-licensed recreational cannabis retail stores open to the public for adult-use sales.
  • 2015 – Medical Integration: Cannabis Patient Protection Act (SB 5052) passes, integrating the medical market with the regulated recreational market.
  • 2016 – Unified Market Launch: The integrated medical and recreational cannabis market takes full effect with enhanced regulations and oversight.
  • 2025 – Registry Updates: New Medical Cannabis Registry system goes into effect, streamlining patient registration and database management.

Washington Possession Limits

Washington law provides different marijuana possession and cultivation limits based on medical patient database registration status and patient type.

  • Medical patients with recognition cards may purchase tax-free up to 3 ounces of usable cannabis, 48 ounces of solid edibles, 216 ounces of liquid edibles, and 21 grams of cannabis concentrate per transaction.
  • Washington marijuana card holders may cultivate up to 6 plants and possess up to 8 ounces from their home cultivation, or up to 15 plants and 16 ounces with special healthcare practitioner recommendation.
  • Medical patients not in the database may possess up to 6 ounces and cultivate up to 4 plants.
  • Recreational users (21+) may possess up to 1 ounce of usable cannabis, 16 ounces of solid edibles, 72 ounces of liquid edibles, and 7 grams of concentrates.
  • Home cultivation is prohibited for recreational users.
  • Maximum of 15 plants per housing unit regardless of number of patients, except for registered cooperatives under state law.
  • All cannabis must be purchased from state-licensed retailers; private sales remain illegal.

FAQs

Sixty-eight percent of Washington state voters approved recreational marijuana legalization for adults.

Washington recognizes specific qualifying conditions including cancer, cachexia, Crohn's disease, glaucoma, hepatitis C, HIV/AIDS, intractable pain, persistent muscle spasms, nausea, PTSD, seizures, traumatic brain injury, and any terminal or debilitating condition. Healthcare practitioners must authorize cannabis use only for these listed conditions.

No, Washington does not accept out-of-state medical cards or allow use of cannabis products purchased from other states. However, adult visitors 21+ can purchase recreational cannabis with valid ID at licensed dispensaries.

Only medical patients can grow cannabis at home. Recognition card holders may grow up to 6 plants (or up to 15 with special authorization) and possess up to 8 ounces from their cultivation. Recreational users cannot cultivate cannabis at home under any circumstances.

Medical cannabis authorizations are valid for one year from the date of issuance. Recognition cards expire annually and must be renewed through the same process of obtaining new healthcare practitioner authorization and re-registering at a medically-endorsed dispensary.

Medical marijuana card holders (in the state database) can purchase larger quantities tax-free, grow up to 6 plants, and possess up to 8 ounces from cultivation. Non-registered medical patients can only possess up to 6 ounces and grow up to 4 plants, with no tax exemptions.
