Virginia Laws
Virginia legalized adult-use medical on July 1, 2021, allowing adults 21 and older to possess and cultivate for personal use. To get therapeutic medical products through licensed dispensaries, patients must meet specific eligibility requirements outlined below.
- The patient should be a Virginia resident and have a valid government ID.
- The applicant must be at least 18 years old or older.
- The patient should be evaluated and recommended by a Virginia-licensed doctor.
- Medical products is legalized for patients with any medical conditions that its use can improve.
- The recreational use became legal for adults 21 and older. This allows them to possess and cultivate a small amount of medical products. But retail sales have not yet begun.
- Using therapeutic medical product publicly is illegal. This can result in penalties.
- Adults aged 21 and above are permitted to grow up to four plants per household for personal use. Plants must be grown out of public view.
- To purchase medical products from a licensed dispensary, you need to bring your ID along with your written certification.
Virginia Reform Timeline
- 2018: Medical Products Expanded to any Health Condition: Patients with any health issue are eligible to apply for a medical card if the licensed doctor approves the condition.
- 2021: Medical Products Legalized: In 2021, Virginia legalized adult-use (recreational) for those 21 and older. They can possess up to 1 ounce, and cultivate 4 medical plants for personal use. But sales for recreational use are _not yet legal_
- 2022: Written Certification Accepted by Licensed Dispensaries: Patients with written certifications no longer need to register with the Board of Pharmacy. Dispensaries could sell directly with those certifications.
Virginia Possession Limits
Public / on-person possession (ages 21+):
- Up to 1 ounce or equivalent product is lawful.
Home cultivation (personal use):
- Up to 4 plants per household, for use at the main residence only, not visible from public view, and with precautions so minors can’t access them; each plant must carry a tag with name, ID, and a note that it is for personal use.
Home storage / possession:
- Possession in one’s private home for personal use is permitted (without penalty), but there is no explicit statutory cap for how much may be stored at home (beyond what would be legal in public).
Sharing / gifting:
- Up to 1 ounce can be shared between adults (21+) with no remuneration (no payment or something of value).
Medical program limits:
- When using the medical program, there are additional dispensing limits (e.g. up to 4 oz of botanical product in 30 days) and product rules for oils, edibles, etc.
