New Mexico: Everything You Need to Know

New Mexico Laws

New Mexico’s medical program was established in 2007 through the Lynn and Erin Compassionate Use Act and is administered by the New Mexico Department of Health. Patients with qualifying conditions can receive medical cards and access products through licensed dispensaries.

  • Patients must be New Mexico residents.
  • Only physicians registered with the program may issue medical recommendations for qualifying conditions.
  • New Mexico medical cannabis cards are now electronic-only, accessed through online patient portal.
  • Home cultivation prohibited for patients under 21; adults 21+ may grow up to 6 mature plants and 6 seedlings with increased limit for medical patients.
  • Primary caregivers may serve up to 4 patients; patients limited to 1 caregiver at a time.
  • Out-of-state medical patients have reciprocity rights with same purchase limits.

New Mexico Reform Timeline

  • 2018 – Program Expansion: Department of Health increases cultivator plant limits and streamlines patient application process to address supply shortages.
  • 2019 – Patient Rights Enhancement: Senate Bill 406 authorizes reciprocity for out-of-state patients and establishes comprehensive employment and civil rights protections.
  • 2021 – Adult-Use Legalization: Governor Michelle Lujan Grisham signs Cannabis Regulation Act, legalizing adult-use cannabis and creating unified regulatory framework.
  • 2022 – Commercial Sales Launch: First licensed sales of recreational cannabis begin April 1, with Cannabis Control Division overseeing commercial operations.
  • 2025 – Current Program Status: The program is fully operational with medical cards and established reciprocity program serving both resident and visiting patients.

New Mexico Possession Limits

New Mexico law establishes separate cannabis possession allowances and a unique units system for medical patients versus adult-use consumers, with medical patients receiving significantly higher limits.

  • Medical patients may purchase up to 15 ounces (425 units) in any 90-day period tax-free.
  • Unit system: 1 unit equals 1 gram dried cannabis or 200 milligrams THC for cannabis products.
  • Adult-use consumers (21+) may possess up to 2 ounces flower, 16 grams concentrate, and 800 milligrams edibles.
  • Medical patients may carry 425 units outside home; adult-use consumers limited to standard possession amounts.
  • Home cultivation limited to adults 21+ for recreational use: up to 6 mature plants and 6 seedlings per person, maximum 12 mature plants per household.
  • Registered medical cannabis patients are allowed to cultivate more: up to 4 mature and 12 immature plants (for a total of 16 plants).
  • New Mexico medical cannabis cards valid for 2 years from approval date.
