Kentucky: Everything You Need to Know

Kentucky Laws

Kentucky’s medical cannabis program was established by Senate Bill 47, signed into law on March 31, 2023, and officially launched on January 1, 2025. The program is regulated by the Kentucky Cabinet for Health and Family Services through the Office of Medical Cannabis. Patients with qualifying medical conditions can receive certification from licensed healthcare providers and will access medical cannabis through state-licensed dispensaries once operational.

  • Patients must be Kentucky residents.
  • Licensed physicians and advanced practice registered nurses with prescriptive authority may certify patients for medical cannabis.
  • Cannabis products will be available exclusively through licensed medical cannabis dispensaries regulated by the state.
  • Home cultivation is strictly prohibited under Kentucky law.
  • Smoking cannabis is illegal; only vaporization, edibles, oils, tinctures, and raw cannabis for other consumption methods are permitted.
  • Patients under 18 must have a designated caregiver to purchase and administer their medical cannabis.
  • Driving under the influence of cannabis remains illegal and subject to penalties.
  • Public consumption is prohibited; use is restricted to private residences.
  • Recreational marijuana is illegal.

Kentucky Reform Timeline

  • 2024 – Regulatory Framework Established: Cabinet for Health and Family Services files 17 comprehensive regulations establishing licensing procedures for cultivators, processors, dispensaries, and patient registration requirements by April 2024.

Kentucky Possession Limits

Kentucky law establishes specific supply limits based on time periods, with practitioners able to authorize higher amounts when medically necessary.

  • Patients may possess up to a 30-day supply at their residence and a 10-day supply on their person (in original dispensary container).
  • Standard 30-day supply limits: 112 grams (4 ounces) of flower, 3,900 mg of THC-infused products (edibles/oils/tinctures), or 28 grams of concentrates.
  • Standard 10-day supply limits: 37.5 grams of flower, 1,300 mg of THC-infused products, or 9.5 grams of concentrates.
  • Practitioners may authorize higher amounts if standard limits would not provide adequate therapeutic relief.
  • Designated caregivers may purchase and possess a 30-day supply for each registered patient they assist.
  • Cannabis must be kept in original dispensary packaging when not at home.
  • Home cultivation is illegal.
  • Kentucky medical cannabis registry cards are valid for one year from issuance and must be renewed annually.
